What is a notary?

Louisiana is a unique state. It has great cuisine, fabulous music and wonderful people.

At one period in Louisiana's history, the state was governed by France and is the only state with a legal system based on civil law, derived from the Napoleonic Code. Other states are governed by common law doctrine. Louisiana notaries are highly trained, licensed practitioners, providing a full range of regulated legal services and have much more authority than notaries of the other 49 states. In fact, in other states much of the transactional authority of the Louisiana Notary Public would be reserved only for lawyers. The Louisiana notary has the ability to prepare powers of attorney, draft affidavits and generally any instrument in writing.

A Notary's duty is to screen the signers for their true identity, their willingness to sign without duress or intimidation and their awareness of the contents of the document or transaction. Some notarizations also require the Notary to put the signer under an oath, declaring under penalty of perjury that the information contained in a document is true and correct. Impartiality is the foundation of the Notary's public trust and they are duty-bound not to act in situations where they have a personal interest.

In order to become a notary public in Louisiana, one must pass a very difficult examination. Once the person passes this exam, he or she receives a commission as a Notary Public for life.
